These Terms of Sale (“Terms”) govern the sale of products by Rocsteadi Productions  (“we”, “us”, or “our”) through our website at rocsteadi.com (the “Website”). By placing an order, you (“you” or the “customer”) agree to be bound by these Terms.

These Terms apply to consumers (individuals purchasing for personal use) and comply with relevant UK laws, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Ordering and Contract Formation

  • Products displayed on the Website do not constitute a legal offer but an invitation to treat.
  • When you place an order, you are making an offer to purchase the products.
  • We will send an order confirmation email, but the contract is formed only when we dispatch the products and send a dispatch confirmation email.
  • We reserve the right to refuse or cancel any order (e.g., due to stock availability, pricing errors, or suspected fraud). If we cancel, we will refund any payment.

3. Product Information

  • We take care to ensure product descriptions, images, sizes, colours, and prices are accurate. However, variations may occur (e.g., due to screen settings or manufacturing).
  • Detailed size guides are provided. Please refer to them before ordering.
  • All products are subject to availability.

4. Prices and Payment

  • Prices are as shown on the Website and include VAT (where applicable) at the current rate.
  • Delivery charges are additional and shown at checkout.
  • Payment must be made in full at the time of ordering via the accepted methods.
  • We may change prices at any time, but changes will not affect orders already confirmed.

5. Delivery and Risk

  • Please see our separate Shipping Policy for details on processing times, delivery estimates, and carriers.
  • Risk in the products passes to you upon delivery.
  • Title (ownership) passes to you once we receive full payment.
  • If delivery is delayed due to events beyond our control (force majeure), we will contact you and take steps to minimise the delay.

6. Faulty or Defective Goods

  • Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described.
  • Please see our separate Returns & Refunds Policy for details on returning faulty items.
  • Your statutory rights are not affected.

7. Cancellation Rights (Cooling-Off Period)

  • As this is a distance contract, you have the right to cancel your order without giving a reason within 14 days from the day after you receive the goods.
  • To cancel, inform us in writing (e.g., via email or our contact form) using the model cancellation form if desired (available on request).
  • You must return the goods to us within 14 days of cancellation, in unused condition with original packaging and tags.
  • We will refund the price of the goods (but not original delivery charges) within 14 days of receiving the returned goods or proof of return.
  • You are responsible for return shipping costs unless the goods are faulty.
  • Important Limitation: Due to hygiene reasons and the nature of apparel, we exclude the right to cancel for items that have been worn (beyond trying on), washed, altered, or where seals/hygiene strips have been removed. Personalised or custom-made items are also excluded from cancellation rights.
  • This does not affect your statutory rights for faulty goods.

8. Limitation of Liability

  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be limited under UK law.
  • We are not liable for indirect or consequential losses.
  • Our total liability for any claim shall not exceed the price paid for the products.

9. Intellectual Property

  • All content on the Website (including images, designs, and text) is owned by us or our licensors. You may not use it without permission.

10. General

  • These Terms are governed by English law, and the courts of England and Wales have non-exclusive jurisdiction.
  • If any part of these Terms is unenforceable, the remainder shall continue in effect.
  • We may update these Terms from time to time. The version applicable to your order is the one in force at the time of ordering.

11. Complaints and Disputes

  • If you have a complaint, please contact us at information@rocsteadi.com. We aim to respond within 1-3 bussiness days.
  • For alternative dispute resolution, you may use the EU Online Dispute Resolution platform (if applicable) or other approved bodies.
